Terms of Service

These Terms govern your use of Echo ("Echo", "we", "us"), a software service that helps physical therapy and rehabilitation clinics run automated patient text check-ins, capture Remote Therapeutic Monitoring (RTM) data and clinical time, and generate chart-ready notes. By creating an account you agree to these Terms on behalf of yourself and the clinic you represent.

1. Who may use Echo

Echo is intended for licensed clinicians and their authorized staff. You must be at least 18 years old and authorized to bind your clinic. Echo is a documentation and communication tool for clinicians — it is not intended for use by patients as an account holder, and it is not a medical device or emergency service.

2. What Echo does

  • Sends automated and clinician-initiated SMS check-ins to patients you enroll, on a cadence you configure (welcome, day 3, day 7, then weekly), within the practice hours and timezone you set.
  • Uses AI to read inbound patient replies and extract structured data such as pain score, home exercise program (HEP) adherence, device days, red-flag signals, and a short summary.
  • Tracks RTM-eligible clinical time (for example message review, clinical SMS exchanges, patient detail review, and EMR note review) and produces a monthly billing summary with CPT eligibility indicators.
  • Generates an editable EMR note you can copy into your own chart system, and writes an audit log entry each time a note is copied.

3. Clinical responsibility

Echo supports your judgment; it does not replace it. AI-generated summaries, extracted scores, red-flag detection, and automated messages may be incomplete or wrong. You are solely responsible for reviewing all content before relying on it, for all clinical decisions, and for the accuracy of anything you place in a patient chart. Echo does not provide medical advice and must not be used for emergencies. Patients should be told to call 911 or seek immediate care for urgent symptoms.

4. Billing and coding responsibility

Time totals, device-day counts, and CPT eligibility flags (including 98975, 98977, 98980, and 98981) are informational aids derived from activity recorded in Echo. You are responsible for confirming that documentation, consent, medical necessity, supervision, and payer rules are satisfied before submitting any claim. Echo does not submit claims and makes no guarantee of reimbursement.

5. Patient consent and messaging compliance

You represent that, before enrolling a patient, you have obtained the consents required by law and by your payers — including consent to receive text messages and, where applicable, consent to remote monitoring services. You are responsible for honoring opt-out requests (such as STOP), for the accuracy of phone numbers you enter, and for complying with TCPA, carrier 10DLC registration requirements, and other applicable messaging rules. Standard message and data rates may apply to your patients.

6. Protected health information

Echo processes protected health information (PHI) on your behalf as a business associate. A Business Associate Agreement (BAA) is available on request and, once executed, governs our handling of PHI and controls over these Terms where the two conflict. Do not put PHI into fields not intended for it (for example marketing or waitlist forms).

7. Your account and data

  • You are responsible for safeguarding credentials and for activity under your account and clinic workspace.
  • You control who you invite to your clinic workspace and what access they have.
  • Your clinic's patient records, conversations, time logs, and audit logs belong to you. We process them to provide the service.
  • You may request an export or deletion of your clinic's data; some records may be retained where law requires.

8. Acceptable use

Do not use Echo to send marketing or unsolicited messages, to harass anyone, to upload data you lack the right to process, to reverse engineer or resell the service, to attempt to access another clinic's data, or to interfere with the service's operation or security.

9. Third-party services

Echo relies on subprocessors including our cloud database and authentication provider, an SMS carrier gateway, and AI model providers. Your use of Echo is also subject to their availability. We are not responsible for outages or actions of these providers, though we require appropriate safeguards where they handle PHI.

10. Pricing

Pricing and paid plan terms are not yet finalized. Any fees, billing cycles, taxes, and refund rules will be presented to you before they take effect, and continued use after that point constitutes acceptance of them. Until then, access may be provided on a trial or design-partner basis and may be limited or discontinued.

11. Service changes and availability

Echo is under active development. We may add, change, or remove features and may schedule maintenance. We aim for high availability but do not guarantee uninterrupted service.

12. Disclaimers and limitation of liability

Echo is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of AI output, and non-infringement. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or claim reimbursement. Our total liability for any claim is limited to the greater of the amounts you paid us in the three months before the claim or US $100.

13. Termination

You may stop using Echo and close your account at any time. We may suspend or terminate access for breach of these Terms, for legal or security reasons, or if we discontinue the service. On termination, automated messaging stops and you should export any data you need.

14. Changes to these Terms

We may update these Terms. Material changes will be reflected in the "Last updated" date and, where significant, communicated to account owners. Continued use after an update means you accept the revised Terms.
